Visitor Terms and Conditions

The following are the Visitor Terms and Conditions for Swarovski Kristallwelten
of D. Swarovski Tourism Services GmbH (hereinafter “Swarovski”)

These Visitor Terms and Conditions for Swarovski Kristallwelten (Swarovski Crystal Worlds) include and comprise the following: (A) General Business Terms and Conditions; (B) Terms and Conditions regarding Conduct, Use, and Attendance at Swarovski Crystal Worlds (hereinafter “Code of Conduct”); (C) Terms and Conditions for Events and Workshops at Swarovski Crystal Worlds and (D) Terms and Conditions for the Use of the Gastronomic Services Area (hereinafter collectively, “Visitor Terms and Conditions”).

T&C

(A) General Business Terms and Conditions

1. Visiting Swarovski Crystal Worlds
By purchasing tickets, entering, and/or using (including free of charge) Swarovski Crystal Worlds (including all facilities, systems, equipment, and parking spaces), the visitor expressly agrees to the valid enforceability of and compliance with these “Visitor Terms and Conditions” in their entirety, specifically the applicability of and compliance with the “Code of Conduct.”

2. Parking Lot
The use of the parking lot is free of charge and at the visitors’ own risk. Parking lot usage is limited to the duration of the visit to Swarovski Crystal Worlds. The Austrian Traffic Code (Straßenverkehrsordnung; StVO) is enforced on the entire parking lot and its access points.The parking lot is not monitored by security. Visitors must ensure that individuals, pets, and valuables are not left behind in their vehicles. Swarovski is exempt from any and all liability for damages (vehicular damage, theft, etc.). Swarovski reserves the right to install surveillance of the parking lot by video camera. This will happen based on its own discretion and under no obligation. Camping, staying overnight, and/or preparing meals are prohibited.

3. Access and stay
Access, stay, and use of Swarovski Crystal Worlds, together with all facilities, systems, and equipment are permitted only during the posted hours of operation, only through the designated access points, and only while complying with the “Visitor Terms and Conditions”, as well as the Instructions on Use and Safety. Children (i.e., persons who have yet to reach the age of 14) are granted access to Swarovski Crystal Worlds and to stay on the premises and use the facilities, systems, and equipment only in accompaniment and supervision of a parent, legal guardian, or at minimum an accompanying person of legal age). Admission to Swarovski Crystal Worlds is granted to minors (i.e., persons who have reached the age of 14, but who have not yet turned 18) under the proviso that their stay on the premises and use of its facilities, systems, and equipment is supervised by and at the responsibility of their parents or legal guardians.

4. Tickets
The purchase of an individual admission ticket entitles the bearer to one-time admission to the exhibition space, and to unlimited access to the playground and garden. (Single admission) tickets and annual tickets are not transferrable. Annual tickets are valid from the date of issuance for the duration of one year.

Visitors are obligated to hold on to their ticket during the entire duration of their stay, and to present this upon request to (any) Swarovski employee.

Lost tickets will not be replaced.

5. Store visit
Guests who wish only to visit the Store will obtain a free ticket that grants them admission to the Store.

6. Use
Visitors may use the facilities, systems, and equipment at Swarovski Crystal Worlds while respecting their designated purpose, heeding and upholding the “Visitor Terms and Conditions” and associated Instructions on Use and Safety as applicable, as well as exercising the necessary diligence and performing the supervisory duties incumbent upon parents and accompanying persons of legal age with regard to their own children and/or those children whom they chaperone. By using the facilities, systems, and equipment, the visitor indicates that he or she has been adequately advised of the Instructions on Use and Safety.

Age and height restrictions: The play area (playtower and playground) may only be used by children who have reached the minimum age of a full four years (48 months) and – if designated for specific game equipment – who meet the minimum height requirement.

Responsibility and supervision: It is incumbent upon parents or accompanying persons of legal age to provide constant supervision of and guidance to the children they accompany during their visit to Swarovski Crystal Worlds. Any use of Swarovski Crystal Worlds and its facilities, systems, and equipment by children or wards in their charge, is contingent upon a realistic assessment by the parents or accompanying persons of legal age as to which activities and equipment are suitable for each child or ward, commensurate with the age and level of development of that child or ward.

The commensurate degree of diligent care is warranted. All entrances and exits must be kept free and clear of obstruction.

All facilities, systems, and equipment, specifically the playgrounds and playground equipment, may be used – without exception – at your own risk, and only under supervision of a parent or accompanying person of legal age. Parents and/or accompanying persons of legal age bear full responsibility for the safety of their own children, chaperoned children, or wards. Parents or accompanying persons of legal age are liable for any breach of their supervisory or custodial responsibilities in regard to their own children and/or those children they chaperone. Parents and/or legal guardians are responsible for the conduct of minors.

Employees: Employees of Swarovski Crystal Worlds provide no supervision whatsoever.

Visitors must always obey the instructions of Swarovski employees immediately under any circumstance.

Employees of Swarovski Crystal Worlds are authorized to deny admission to Swarovski Crystal Worlds and to escort off the premises those persons who conduct themselves in contravention to the “Visitor Terms and Conditions,” comport themselves in any other unreasonable and unseemly manner, or who are staying at Swarovski Crystal Worlds without a standard and valid ticket. Costs will not be reimbursed. Damages compensation claims cannot be asserted by the aforementioned person or persons.

7. Liability

Swarovski’s liability for damages suffered in connection with the visit to Swarovski Crystal Worlds, specifically the use of facilities, systems, and equipment, is excluded to the full extent, as long as no compelling legal provisions mandate otherwise. Liability to consumers as defined in the Austrian Consumer Protection Act (Konsumentenschutzgesetz; KSchG) for property damages caused by minor negligence is excluded; this does not apply to personal injury. Any complaints must be filed in all cases at the ticket counter prior to exiting Swarovski Crystal Worlds; this requirement also applies to cases in which any damages come to light at a later point in time. No consideration shall be given to claims asserted at a later date.

Swarovski assumes no liability for any soiling, damage, or other adverse effect to the visitors’ personal items or clothing, specifically if these result from the failure to uphold the Code of Conduct or safety regulations. Similarly, Swarovski bears no liability for loss or theft of the visitors’ personal items.

8. Lockers
There is a limited number of lockers available for use at no charge in the entrance area and on the ground floor of the playtower. Visitors use these lockers at their own risk. Any duty of care or liability by Swarovski due to loss, theft, damage, etc., to the contents of those lockers is excluded. 

9. Dogs
Visitors may bring dogs only up to the arrivals building/Grand Plaza of Swarovski Crystal Worlds, and as such it is only permitted while on a leash and only with muzzle. A limited number of dog kennels are available for use free of charge at the entrance area; visitors use these at their own risk. The safe custody of dogs in dog kennels is the sole and exclusive responsibility of the visitor. Swarovski undertakes no duty to provide care and assumes no liability. Visitors must notify the staff at the ticket counter of any guide dogs to be brought in. No other pets are permitted at Swarovski Crystal Worlds. Dog owners must remove any pet feces.

10. Maintenance
Sections of Swarovski Crystal Worlds may be temporarily closed due to maintenance and cleaning duties, or for operational failure due to technical reasons. Swarovski reserves the right to restrict or close access to Swarovski Crystal Worlds for safety reasons or in force majeure events, or arrange to have Swarovski Crystal Worlds evacuated if the need arises. This circumstance may not serve as a basis to justify claims to reimbursement of ticket price, either in whole or in part.

11. Film and photography
Visitors are hereby notified that filming and photography may be conducted at Swarovski Crystal Worlds, by Swarovski or third parties, specifically as part of events and workshops. Visitors who do not wish such recordings or their potential subsequent publication are requested to avoid such areas where filming and photography take place. If the visitor does not expressly indicate to the contrary, then Swarovski assumes that the visitor consents, for himself/herself and on behalf of his/her children, minors, wards, the irrevocable publication in any contemporary and future media, as well as the use of their unremunerated image and/or their voice, specifically for photographs, live broadcasts, broadcasts, and/or recordings in image and/or sound, that Swarovski or its agents may create in connection with the visit to Swarovski Crystal Worlds and/or the event attended.

Filming and photographing for private purposes is permitted; however, visitors are themselves responsible for ensuring that any requisite approvals are obtained from the individuals depicted. Commercial recordings (film and photograph) are permitted only after prior authorization by Swarovski's press department has been obtained.

Video recording: At times, video recordings are carried out inside Swarovski Crystal Worlds.

12. Audio devices
The use of radio, phonographic equipment, tape recorders, or other audio devices or musical instruments is prohibited throughout the entirety of Swarovski Crystal Worlds. 

13. WLAN
Swarovski Crystal Worlds makes WLAN access available to its visitors free of charge. To use it, visitors must first accept the Terms and Conditions for Use when logging in to the WLAN. Any liability by Swarovski is excluded.

14. Applicable Law
Any visit to Swarovski Crystal Worlds, as well as the associated legal concerns – together with the “Visitor Terms and Conditions” and those regulations governing conduct and stay at Swarovski Crystal Worlds are exclusively subject to the laws of the Republic of Austria, excluding the conflict-of-law rules. If provisions contained in these Visitor Terms and Conditions become invalid or unenforceable, either in whole or in part, then this circumstance shall not affect the remaining provisions. A provision shall replace the invalid or unenforceable provision or portion thereof that most closely approaches the original business intent of the invalid or partially invalid provision, in a valid and enforceable manner. 

Conduct

(B) Code of Conduct

Terms and Conditions regarding Conduct, Use, and Attendance at Swarovski Crystal Worlds (hereinafter “Code of Conduct”);:

Use, supervision, age, height

  • All Use and Safety Instructions and pictograms must be observed and upheld in strict compliance. The instructions of Swarovski employees must be implemented immediately.
  • Parents or accompanying persons of legal age must themselves continuously and exclusively supervise and instruct the children and/or wards in their care throughout the entire area of Swarovski Crystal Worlds. Employees of Swarovski Crystal Worlds provide no supervision whatsoever.
  • All facilities, systems, and equipment may be used at the visitors’ own risk. Parents or accompanying persons of legal age are liable for their own children and/or the children or wards they chaperone. Any use of Swarovski Crystal Worlds and its facilities, systems, and equipment by children or wards in their charge, is contingent upon a realistic assessment by the parents or accompanying persons of legal age as to which activities and equipment are suitable for each child or ward, commensurate with the age and level of development of that child or ward. 
  • Playground equipment in the area of the playtower and on the playground have been exclusively configured for persons who have reached the minimum age of a full four years (48 months), and where indicated for a minimum body height of 110 cm. Responsibility in this regard is incumbent upon the parents and/or accompanying persons of legal age. The children’s swing set and sandbox in the playground may also be used by children under four years of age (48 months); however, such use is granted only under the constant supervision of a parent and/or accompanying person of legal age.
  • Parents and/or accompanying persons of legal age must maintain constant visual contact with their own children or any children or wards in their charge who may be at or near any water surface or body of water.
  • The use of helmets is strictly prohibited on the premises of Swarovski Crystal Worlds. Helmets, scarves, necklaces, (hand)bags, backpacks, etc., or other objects associated with the risk of injury or trip-and-fall accidents are strictly prohibited when using the playground/playground equipment or the other facilities, systems, and equipment.
  • The use of the facilities, systems, and equipment is permitted exclusively for their intended purpose, in the specified body posture, and in compliance with the Instructions for Use and Safety.
  • Swarovski Crystal Worlds permits the use of the following roller-propelled devices only: baby strollers/perambulators, rollators/walkers with wheels; wheelchairs, and equipment with handlebars. All other roller-propelled devices, including roller skates, scooters, skateboards, bicycles, and walking bikes, or other sports equipment) are prohibited throughout Swarovski Crystal Worlds. This specifically applies to the playtower and the playground
  • Darkness and – in some places – the predominantly spatial narrowness of the Chambers of Wonder may cause some visitors to lose their orientation and/or lead to claustrophobia. Please exercise all due diligence and care if you suffer from epilepsy.


Park

  • Lawns – if they are even and easy to walk on – are an open invitation to enter, stay, and relax.
  • A selection of movable chairs and lounges are freely available for use. We request that you leave these furnishings in the designated areas of the Crystal Cloud and the playground. Camping is not permitted.
  • Depending on weather conditions (rain, sleet, snow, etc.), there may be a greater risk of slipping and falling, or the limited winter service may have to be enforced. Visitors are requested to conduct themselves commensurate with the weather conditions; please pay attention to and follow the posted signage and any cordons, or barriers.
  • All visitors are prohibited from walking on flower meadows or climbing trees, artworks, structural features like walls, other installations, buildings, guardrails and barriers, steep slopes and hills, and any areas that are marked accordingly. Do not pluck the flowers.
  • You are prohibited from stepping past or removing fences, safety barriers, barriers, or cordons of any kind.
  • Water is suitable for drinking only from those facilities clearly marked as drinking water.
  • Entering any body of water or water facility is strictly prohibited. In the winter months, visitors are strictly prohibited from walking on any frozen body of water or ice-covered surface. 


General Conduct

  •  We request that you treat other visitors with consideration and respect, bearing in mind the purposes of the facilities, systems, equipment, buildings, spaces, and fixtures. Disturbances to public order, the use of physical or verbal violence, drunkenness, violations of commonly accepted good manners, violation of the “Visitor Terms and Conditions,” (attempts to cause) damage, and related conduct may lead to your immediate ejection from Swarovski Crystal Worlds, without claim to cost reimbursement or damages compensation.
  • Telephone calls are not permitted inside the Chambers of Wonder at Swarovski Crystal Worlds (exhibition space).
  • Consumption of your own supply of alcoholic beverages is prohibited throughout the entire premises. The consumption of food and drinks is not permitted in any building.
  • Smoking is permitted only in designated smoking areas. This also applies to electronic cigarettes.
  • Setting fires and any handling of open flame is strictly prohibited throughout the entirety of Swarovski Crystal Worlds.
  • Trash should be placed in the designated containers.
  • The possession and carrying of weapons or other hazardous objects, and the use of illegal items or substances, are prohibited in Swarovski Crystal Worlds. Swarovski retains the right to conduct bag searches.
  • Any and all commercial activities, the offering and sale of goods or services, advertising promotional measures (including distribution of handbills, flyers, and/or brochures, or carrying signs or posters), the organizing of games of skill or games of chance, and the act of panhandling are expressly and explicitly prohibited throughout the entire area of Swarovski Crystal Worlds (including its associated facilities, systems, and equipment).
Events

(C) Terms and Conditions for Events and Workshops

  • For attendance at events and workshops for families, children, and/or minors at Swarovski Crystal Worlds, Swarovski reserves the right to apply special requirements, especially with regard to age or minimum prerequisites for participants. This applies particularly in regard to the materials, tools, and techniques to be used. Swarovski reserves the right to reject participation in events or workshops in justifiable cases.
  • Parents or accompanying persons of legal age of children or minors participating in such events or workshops are obligated to sign a permission slip prior to the start of the corresponding event, and to state their complete contact information, in detail, that would facilitate the direct initiation of contact at any time. Parents must additionally state who is authorized to collect the child in attendance; the event employees at Swarovski Crystal Worlds are not authorized to surrender the child to an individual other than the one indicated, or to leave the child alone unattended. Swarovski also reserves the right to apply other terms and conditions in this permission slip that would attain validity in addition to these Terms and Conditions.
  • Parents or accompanying persons of legal age are obliged to hand over their children, in person, to the designated Swarovski Crystal Worlds event employees, and to return again at the designated time after the event (themselves or an appropriately authorized adult of legal age), so they can collect their children. Parents or accompanying persons of legal age must inform their child/minor about the fact that during the event or during the workshop, they are absolutely required to carry out the instructions of the Swarovski Crystal Worlds event employees.
  • Parents or accompanying persons of legal age are obligated to notify the Swarovski Crystal Worlds event employees of any applicable health concerns or requirements of any kind (e.g., allergies, intolerances, epilepsy, etc.), special behavioral matters (e.g., delayed development), and any other requisite information and needs of the attending children/minors. The Swarovski Crystal Worlds event employees are not authorized to dispense medications to children/minors (that they brought with them) and/or to monitor their self-administration.
  • In the event of emergency, first aid measures can be arranged and/or the child/minor be brought to a physician or hospital. The parents or accompanying persons of legal age will be notified immediately in this case. For the duration of the care, medically necessary decisions must be made based on the best judgment of the physician or – in the event of imminent danger – the best judgment of the Swarovski Crystal Worlds event employees.
  • If the event or workshop also involves the providing catering to the participants, then Swarovski and/or the Swarovski Crystal Worlds event employees assume no liability for allergic reactions due to allergies or intolerances that were not expressly disclosed (and documented when participating children/minors are involved).
  • Swarovski Crystal Worlds event employees explain and demonstrate the proper and safe handling of materials, tools, and techniques. Swarovski assumes no liability for participant’s inappropriate or improper use of these. It likewise assumes no liability for loss, soiling, damage and/or other impairment to the objects or clothes that participants bring with them.
  • Participation in events and workshops is only authorized for those participants who possess up-to-date insurance for illness, accident, and liability.
  • Swarovski makes no guarantee, warranty, and assumes no liability for products made by the participants during an event or workshop.
  • The Swarovski Crystal Worlds “Visitor Terms and Conditions” apply to these events and workshops, specifically the conditions of the “Code of Conduct.”
Gastronomy

(D) Terms and Conditions for the Use of the Gastronomic Services Area

  • Visitors are not permitted to consume food or drinks that they brought in.
  • Smoking is absolutely prohibited throughout the entire Gastronomic Services Area.
  • Visitors are not permitted to bring pets and animals to the Gastronomic Services Area. There are dog kennels available at the entrance area.
  • Swarovski assumes no liability for items left at coat check.
  • Pursuant to the Tyrolean Child and Youth Protection Act (Tiroler Jugendschutzgesetz), no individual may be given alcohol until they have reached the age of 16.
